Tracy v. Asbestos Corporation Limited, et al.

Hawkins Parnell Thackston & Young LLP (HPTY) obtained summary judgment on behalf of United Parcel Service of America, Inc. (UPS), a leader in global commerce. David Marshall and Eric Hawkins represented UPS in this case involving peritoneal mesothelioma that the plaintiff alleged was from occupational exposures as a mechanic for UPS.

Plaintiff worked as a contract mechanic at UPS in the 1980s and, he alleged that he worked with asbestos-containing brakes, clutches, and gaskets during his work. After extensive discovery, UPS argued that while certain products were identified, Plaintiff could not prove that the products at UPS contained asbestos. The court agreed with UPS’s argument and held that a jury would be forced to speculate as to whether the Plaintiff worked with any asbestos-containing product at UPS.
