Hawkins Parnell Thackston & Young LLP obtained a defense verdict in a suit arising out of an alleged slip and fall in an HEB grocery store by a woman who was 8 months pregnant. Several months after the child was born, it was discovered he had deficits, leading to the eventual diagnosis of Cerebral Palsy. The case went to trial in November 2017, in the 53rd District Court of Travis County, Texas. Plaintiffs called Dr. James Wheeler of Houston to testify as to causation; they also called life care planner, Dr. Todd Cowen, who opined that $83,000 was needed for future medical care, and Thomas Roney, who testified that the minor’s loss of earning capacity was $2.2 million. After 7 trial days of trial and after deliberating about an hour and a half, the jury announced a unanimous defense verdict. HPTY partner Ranelle Meroney represented HEB.
