Ed Slaughter, Jason Irvin, and Saxon Guerriere Obtain Summary Judgment in Illinois Mesothelioma Case

Ed Slaughter, Jason Irvin, and Saxon Guerriere won summary judgment in the United States District Court for the Northern District of Illinois for a prominent design, engineering, and construction company.

In this wrongful death mesothelioma case, Plaintiff sought damages for negligence alleging her husband was exposed to asbestos dust and fibers while on the job. Decedent was an engineer who worked commissioning various types of boilers on-site at many power plants across all or part of several Midwestern states. Before recounting defendant-specific facts, the court noted that there is no factual dispute about whether the Decedent was exposed to asbestos dust and fibers while working at the defendants’ plants.

HPTY was granted summary judgment based on sophisticated construction law and contract interpretation theories. The judgment was granted by the Honorable John J. Tharp, Jr. without oral argument on moving papers drafted by Saxon Guerriere.
