Alan Herman Obtains Dismissal in Product Liability Fire Case
Alan Herman won a dismissal without payment on behalf of a manufacturer of water heaters in a product liability case pending in Santa Clara, California.
The case arose out of a fire in a Fifth Wheel recreational vehicle which consumed the Fifth Wheel and spread to the homeowner’s residence. A lawsuit was filed against the manufacturer of the Fifth Wheel and against the dealer originally seeking close to $1 million dollars. Although the Plaintiff did not name or sue HPTY’s client, they were brought into the case as a cross-defendant. After substantial discovery and excellent expert witnesses, a resolution of the case was reached involving the dismissal of HPTY’s client.
