Barret Marshall and Todd Martin Obtain Dismissal of a Household Exposure Mesothelioma Claim

Barret Marshall and Todd Martin obtained a dismissal in a wrongful death case in which the plaintiffs alleged that the decedent encountered asbestos fibers from laundering her husband’s work clothes.  Before the decedent died, HPTY requested that the plaintiffs preserve sufficient pathology tissue to conduct a digestion study to determine whether there was asbestos in her lung tissue.  After the decedent’s death, the plaintiff failed to produce the requested pathology and subsequently dismissed the claims against HPTY’s client.
